A while ago, in the 1950's, the FDA passes a regulation that forced cigarette companies to place warning labels on the side of their products, informing consumers of the dangers of the consumption of their product. Well, if people know about the effects, wouldn't a case be deemed frivolous in court? How is their case heard?
